- “Acceptable Use Policy” or “AUP” means the policy which sets out the binding guidelines for a client’s acceptable use of the Afrihost System and Services.
- “Afrihost” means Afrihost SP (Pty) Ltd or any other entity which Afrihost SP (Pty) Ltd may assign, cede or delegate any of its rights or obligations to.
- "Afrihost System" means equipment operated together as a system by Afrihost to provide any Service, including without limitation servers, peripherals, routers, switches, Software, Database, cables, generators, and uninterruptible power supplies.
- “Afrihost Website” means the internet website published at the URL “www.afrihost.com” (including sub-domains) or another URL that Afrihost notifies the Client of from time to time.
- “Agreement” means these General Terms, Acceptable Use Policy, Sanctions Policy, and applicable Service Terms, Service Orders and all annexures to any of these documents.
- “AirMobile App” means the smartphone, feature phone or tablet application that is published by Afrihost to facilitate the use of AirMobile Services, and forms part of the Client Interface.
- “AirMobile SIM” means a SIM issued to the Client by Afrihost.
- “AirMobile Website” means the internet website published at the URL www.airmobile.co.za (including sub-domains) or another URL that Afrihost notifies the Client of from time to time, and forms part of the Client Interface.
- “Airtime” means time allocated by a mobile network operator to a specific user or account so that cellular phone calls can be made and received.
- “App” means a computer program or piece of software designed to fulfil a specific purpose on mobile and desktop environments. Clients are required to download and install the App in order to use it.
- “Application” means a request for initiation of a Service and / or provision of a Good.
- “Business Day” means any day other than a Saturday, a Sunday or a public holiday in the Republic of South Africa.
- “Business Hour" means a period of 60 (sixty) minutes between the hours of 08h00 and 17h00 South African Time, on a Business Day.
- “Calendar Month” means the period from the 1st day of a month to the last day of that month.
- "Client” or “you” is the party described as the Client on any Application or Service Order and will either be you or the entity that you represent.
- "Client Data" means Data:
- transmitted to the Client using the Afrihost System,
- stored by the Client on the Afrihost System (or on the Client’s system as the case may be), or
- transmitted by the Client via the Afrihost System, in the day-to-day utilisation of a Service.
- "Client Equipment" means any equipment installed at Afrihost’s premises by the Client that Afrihost does not own, including without limitation servers, peripherals, routers, switches, Software, Databases, data cables, and uninterruptible power supplies.
- "Client Interface” means the ClientZone website, ClientZone mobile App, Airmobile App, and all other platforms made available to Clients by Afrihost which allow Clients to access and vary their account details and Services, track Service usage, and the like.
- "Coverage Area" means the latest estimated services coverage area in South Africa (as updated from time to time) and illustrated by the coverage map available at https://www.afrihost.com/lte or https://www.afrihost.com/5g on a daily basis.
- “CPA” means the Consumer Protection Act No. 68 of 2002, as amended from time to time.
- “CPE” means the Client-premises equipment owned by a Last-mile Provider that is used by the Client to connect to a telecommunications network.
- “Data" means electronic representations of information in any form and in the context of a mobile service, means the transmission of broadband internet data via the network, usually attributed to a specific Client, User or account.
- “Database” means a collection of related Data including, but not limited to, text, images, sound and video, all of which have been created and integrated using a method of connecting and displaying the Data into a collection of interrelated independent files or Data which are stored together.
- “Device” means any mobile, transportable or portable cellular mobile terminal, handset, device, laptop, computer, modem or other apparatus which is capable of connection by radio interface to a network.
- "Domain" or “Domain Name” means a web address which is an internet subdomain registered with an authorised Registrar appropriate to its top-level domain (“TLD”) like .com or .org, and includes the Domain’s constituent server records including, but not limited to, host names, aliases and mail exchange (“MX”) records.
- “ECTA” or “ECT Act” means the Electronic Communications and Transactions Act No. 25 of 2002, as amended from time to time.
- "Emergency Maintenance" means maintenance to the Afrihost System which is intended to remedy existing circumstances or to prevent imminent circumstances that are likely to cause danger to persons or property, an interruption to the communication services, or substantial loss to Afrihost, the Client or any third party.
- “EULA” means End User Licence Agreement, which is a legal contract between Microsoft and Clients who use Afrihost’s dedicated hosting and/or Linux reselling services, which Clients agree to by the use thereof.
- “Fee” means the fees and charges payable by the Client in respect of the Services.
- “General Terms” means the general terms and conditions on the Afrihost Website, found here.
- “Goods” means any and all goods which may be provided by Afrihost to the Client in terms of this Agreement, including without limitation equipment, hardware and third party Software.
- “Good Industry Practice” means the exercise of that degree of skill, diligence, prudence and foresight which would reasonably be expected from a skilled and experienced service provider providing similar services to those provided under this Agreement. Such a service provider would seek in good faith to comply with its contractual obligations, and with all applicable laws, codes of professional conduct, relevant codes of practice, relevant standards, and all conditions of planning and other consents.
- “Hosting” or “Web Hosting” means the process where a Client rents server space and bandwidth through Afrihost or another company so that the Client’s website can be published on the internet.
- “ICASA” means the Independent Communication Authority of South Africa.
- “Intellectual Property” means patents, registered designs, trade marks (whether registered or otherwise), copyright, trade secret rights, database rights, design rights, service marks and other intellectual property rights and rights to claim something as confidential information, including in other jurisdictions, that grant similar rights.
- “Last-mile Provider” means the operator of the network or fibre network operator that physically reaches the Client’s premises by means of fibre optic cables in order for the Client to connect to and use Afrihost’s Services such as Fibre Services.
- “Malicious Code” means anything that contains any computer software routine or code intended to:
- allow unauthorised access or use of a computer system by any party; or
- disable, damage, erase, disrupt or impair the normal operation of a computer system; and
- includes any back door, time bomb, Trojan horse, worm, drop dead device or computer virus.
- “Mobile Number Portability” or “MNP” means a service that allows a SIM card to change (or “Port”) telecom carrier networks while keeping the same unique calling number.
- “Monthly Allocation” means the commencement value of the Client’s Airtime, Data and SMS balance, as applicable, at the commencement of each Calendar Month according to the Client’s selected Service package.
- “Month-to-month” means a Service where the Client makes fixed monthly payments for a Monthly Allocation, which can be terminated on a Calendar Month’s notice.
- “MSISDN” means a number uniquely identifying a subscription in a mobile network.
- “MTN” means Mobile Telephone Networks (Pty) Ltd with Registration No. 1993/001436/07 but may refer to MTN, Mobile Telephone Networks, MTN SA, MTN Group, MTN (PTY) LTD, or any other trading name or subsidiary associated with this entity.
- “MTN Mobile Terms” means the MTN Terms and Conditions available here or otherwise as published by MTN from time to time on its website.
- "Multi-Factor Authentication" or “MFA” refers to the process of establishing a user's identity using several concurrent means of verification such as one-time pin, security questions or other forms of validation.
- "OTP" means One-Time Pin or One-Time Password that is used for login to Afrihost Systems or for verification purposes.
- “Personal Information” means information relating to an identifiable, living, natural person as defined in POPIA.
- “POPI” or “POPIA” means the Protection of Personal Information Act 4 of 2013, as amended from time to time.
- “Prepaid” means a Service which is paid in advance and requires no further payment until the expiry of the term of the Service.
- “Promotion” or “Promotion Package” means any promotion or promotion package offered by Afrihost on a Service as further set out in the specific Service Terms.
- “Registrar” means a Domain Name registrar who is accredited by the relevant Registry or other authority to manage the registration, management and renewal of Domain Names in a Registry.
- “Registry” means the Database of all Domain Names registered in a name space, or the party responsible for maintaining that Database, depending on the context.
- “RICA” means the Regulation of Interception of Communications and Provision of Communication-related Information Act 70 of 2003, as amended from time to time.
- “Roaming” means the ability to make and receive voice calls, send and receive Data, and access other Services when travelling outside of the geographical area of South Africa.
- “Sanctions Policy” means the policy which sets out the guidelines and procedures designed to prevent and address bribery, corruption and violations of sanctions within Afrihost, available here.
- “Services” means service provided by Afrihost to the Client in terms of this Agreement and for each specific service offering the meaning will be specified in more detail, as provided in the additional Service Terms and/or the Client Interface for each of the listed options.
- “Service Order” means a Goods, licence, Services and / or work order agreed to in terms of this Agreement describing the specific Goods or Services to be provided by Afrihost to the Client.
- "Service Terms" means a document describing the terms on which Afrihost will provide a particular Good or Service, as amended from time to time.
- “SIM” or “SIM card” means the Subscriber Identity Module allocated to a user to gain access to the network, and includes reference to an eSIM.
- “SIP” means Session Initiated Protocol which is a technology consisting of a set of online standards used in VoIP that allows a Client to make voice calls.
- “SMS” means Short Message Service, which is a text messaging service.
- "Software” means any computer programme (whether source- or object code), as well as any Database structure or content, artistic work, screen layout, cinematograph film, sound recording, preparatory material, user or technical documentation or any other work created in connection therewith and any modifications, enhancements or upgrades thereto.
- “Supplier” means a supplier of Goods and / or Services to Afrihost.
- “Support” means the assistance, provided by Afrihost to its Clients to ensure the continued and effective use of Afrihost’s Services, taking place on various communication channels including, WhatsApp, email, telephone and chatbot.
- “Terms” means specific rules, conditions and guidelines that govern a Client’s use of the Services provided by Afrihost. Terms include, but are not limited to, General Terms, Service Terms, this glossary, AUP, privacy policy and sanctions policy.
- "Telkom" means Telkom SA SOC Limited, a listed company duly incorporated in the Republic of South Africa, with registration number 1991/05476/30.
- “Telviva” or “CTEL” means Telviva (Pty) Ltd, a private company incorporated in South Africa, with registration number 2007/014820/07.
- “Top-up” means to purchase additional Airtime, Data, SMS or other service credits from a service provider like Afrihost.
- "Two-Factor Authentication" or “2FA” refers to the process of establishing a user's identity using two concurrent means of verification such as one-time pin, security questions and/or other forms of validation.
- “Uninterrupted Power Supply” or “UPS” means a device that, subject to its capacity, provides an alternative temporary power supply to devices connected to the UPS, such as WiFi routers or Mesh-WiFi devices.
- "User/s" means the Client or any other person duly authorised by a Client accessing any of the Services provided by Afrihost.
- “Value Added Services” or “VAS” means charged at the VAS call rate, are provided by MTN and/or Value-Added Service Providers in order to make available to MTN customers a selection of value added services provided by means of the MTN network. Value Added Services are defined as non-core services, or in short, all services beyond standard voice calls, the content of which may not have anything to do with MTN’s mobile network and/or services.
- “VoIP” means Voice over Internet Protocol, which is a technology that uses a set of online standards to transport voice calls over an internet Service, such as Fibre, LTE or DSL.
